Vogue Photo Booths Terms and Conditions Rental Agreement


The following contract and its terms will set forth an agreement between Vogue Photo Booths "Provider" and requesting "Client", for photo booth services for the requested event date. This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.




CONDITIONS

We accept the responsibility to check and confirm all details prior to our event.


We understand the photo booth must be undercover and out of the way of any damaging weather conditions including undercover and out of harm's way. We understand that if the wind is too strong for any enclosed photo booth, Vogue Photo Booths will use their discretion and provide an open-style booth instead. This may also change the backdrop provided. A price reflection will not be honored.


If we deem it fit to have the photo booth in a specific location, even with the approval of a Vogue Photo Booths' representative, any damages sustained for any reason will be at the cost of ourself, the Client, and the event holder named in “who is the event for”.


We understand if the location of the photo booth is allowing wind/air flow, the curtains may blow around.  This may cause the backdrop to also move in and out of the photos taken.


We understand if the location of the photo booth is outdoors, the picture output may be altered due to lighting or weather conditions.


We understand that we assume responsibility for the photo booth and all its contents and inclusions between photo booth drop off and pick up.


If a 3rd party is allocated or is left in charge by ourselves and or the event holders named in “Who is the event for” to place or locate the photo booth in unidentified harm’s way, we and the named individuals will be responsible for any damages occurring.


We agree to advise Vogue Photo Booths in writing of any changes to the contract details listed in this agreement.


In the unlikely event of a technical issue, we agree that it can take up to 1 hour for a Vogue Photo Booths representative to rectify the issue. No discount or refund will be issued if the photo booth is back to the Provider's satisfactory operating level. Otherwise, a discount or partial refund is at the discretion of Vogue Photo Booths.

We agree that Vogue Photo Booths will have access to the event venue at least 1 hour of rental time. We are aware of the possible interruptions of guests and/or ceremony and special timeline events with the agreed time to set up the photo booth unless prior arrangements have been made and agreed to by both parties *with Idle Time available to be added on to set up earlier to prevent any interruptions.

Please send a picture of the invitation to Vogue Photo Booths at least one (1) week prior to the event.



PAYMENT AND FEES


We confirm we have received a contracted price for our photo booth rental. We agree to make the required payments as per the contract.


We agree that payment of the initial $200 booking fee confirms our booking for Vogue Photo Booths services and in the event of a cancellation this fee is non-refundable.


We agree to pay the $200 booking fee and the remaining amount due is to be paid in payments or in full no later than thirty (30) days prior

to the event.

We agree that any damaged or stolen goods between drop off and pick up times will be replaced at new for old within 1 week of the event.

We agree to pay a $50.00 fee for any and all returned payments paid to Vogue Photo Booths.

We agree there may be additional travel fees needing to be added to the rental package with required payment if services are outside Vogue Photo Booths' service travel area (will be notified by Vogue Photo Booths within 24 hours).



ACCESS, SPACE & POWER FOR PHOTO BOOTH


We will arrange for an appropriate space on a solid floor (not grass) of a 10'x10'x8' area for the set up of the Photo Booth at the event's venue.


We will provide a 6 ft or 8ft rectangle table for props as well as a small drink/bistro table to help prevent mishandled drink/food items from harming photo booth equipment and/or guest-of-honor's memory keepsake book.


We are responsible for providing power for the photo booth. The photo booth requires a minimum 110V, 10 amps, and 3-prong outlet from a reliable power source within 50 feet (along a wall) of the setup area. The circuit must be free of all other connected loads. We accept any delay in the performance or damage to the photo booth equipment due to improper power or necessary space.

We shall provide crowd control if warranted and safe and appropriate working conditions and furnish Vogue Photo Booths with directions to the event.

We understand that if we are negligent in any of these conditions, Vogue Photo Booths reserves the right to protect its equipment from any possible weather or hazardous conditions or potential hazardous outcomes by refusing to set up any of Vogue Photo Booths' equipment. No refunds will be offered in these scenarios.


We understand the photo booth needs to be protected from all forms of weather conditions including wind, rain, heat and more. Where possible we will make every effort to set the photo booth up in a corner and have coverage with a roof or tent.


We understand there needs to be a minimum of 10 feet of height for the photo booth to fit comfortably.


We will have an extension cord to the photo booth site ready to use by Vogue Photo Booths.


We understand that some rural properties do not show up accurately on mobile phone Map apps. We will check that the address given to Vogue Photo Booths reflects that of the property or venue. We are aware if this is not done properly it may lead to a late photo booth set up time.


We will let the Vogue Photo Booths team know if their equipment is powered by a generator (not preferred).




DATE CHANGES & CANCELLATIONS


We agree that any retainer fees paid are non-refundable even if we no longer require the services of Vogue Photo Booths.


We agree and acknowledge that we can transfer our retaining fee to another date and time (if available by Vogue Photo Booths) within a 12-month period. If there is no availability for the alternate date, the retainer fee shall be forfeited and the event canceled.


We agree if our event is canceled within 7 (seven) days of our event date, any monies paid are non-refundable unless contradicted by COVID-19 Special Conditions as mentioned in this agreement.


We agree that we have the right to pay any amount of monies owing up until thirty (30) days prior to the event date and is completely up to our discretion to do so.  We acknowledge that no refunds will be given on any amounts paid if the event is canceled within seven (7) days prior to event start date unless contradicted by COVID-19 Special Conditions as mentioned in this agreement.



COVID-19 SPECIAL CONDITIONS


We understand that if my event is affected by state or federal direction for COVID–19, we have the choice to keep an open booking and move to an available Vogue Photo Booths date.


We agree that retainer fees are not refundable and can be transferred to an available Vogue Photo Booth date.


We acknowledge in the event of a lockdown or local area restrictions that occur within the seven (7) days of the event date and full payment has been made, we can move the booking to an available Vogue Photo Booths date, or we can choose to have a refund less retainer fee.



RELEASE AND EXCLUSIVITY


We give permission for Vogue Photo Booths to use any photographs taken during the event for display, reproduction, advertisement, and marketing purposes. We hereby release and discharge Vogue Photo Booths from any liability from publications, including without limitation, any claims for libel or invasion of privacy. Unless stated otherwise in writing submitted to Vogue Photo Booths prior to the event.




DISCLAIMER


While every effort will be made to provide the goods and services as described in the contract, Vogue Photo Booths will not be held liable and the client agrees to indemnify Vogue Photo Booths, its staff, and any party associated with Vogue Photo Booths for any errors or omission and any condition including but not limited to inclement weather, natural disasters, or other circumstances out of control of Vogue Photo Booths, which results in any variation to the provision of the goods and services discussed.


As operations of the photo booth may need to be interrupted for maintenance and paper/ink/ changing of the equipment, the Provider agrees to be operational for a minimum of 80% during the rental period.


Some Booking Forms and T&Cs may be outdated, please contact us directly for the latest Booking Form. Some backdrops, add-ons, and photo booth packages are subject to availability. Vogue Photo Booths will do its best to make sure there is no double booking of backdrops, add-ons, and booth packages. In the event this happens Vogue Photo Booths will preference the client who made the booking deposit first.


Transmissions may be impacted in poor internet coverage areas and or weak Wi-Fi signals.


If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed severed from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the Client agrees to solve any arguments via arbitration. In the event the Provider is unable to supply a working Photo Booth for at least 80% of the Service Period, the Client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on site, the Provider will be allowed to send an email to the client where their guests can then receive email from the Client, and the Provider will send prints free of charge with free shipping to the Client as well as the ability to download the digital files for their own use.




LIABILITY


Vogue Photo Booths will take every care but liability in the event of non-supply of images discussed, (e.g.: camera stolen, camera failure, accidents causing harm to the booth, and any other unforeseen incidents occurring to the booth operator and/or equipment). Retake of photos or refund of monies paid will be under the discretion of Vogue Photo Booths.


If the photo booth camera has been altered by anyone between drop off and pack down from the original focus point, Vogue Photo Booths is not liable or held responsible for out-of-focus photos provided. Vogue Photo Booths’ team members will use their discretion as to their safety. If they feel they are being threatened or treated unfairly, they will first consult you, the client, to fix the situation, if this does not resolve matters then the staff of Vogue Photo Booths reserve the right to choose to leave. No refunds of monies paid and full contractual price will be charged in these circumstances.


Client acknowledges responsibility for any damage loss or misuse of the Provider's equipment by Client or guests (invited or uninvited) or theft or disaster (including fire, flood, or earthquake).
